ORDER Re: 1) Motion to Waive Appellate Filing Fee. 2) Motion to Consolidate this Appeal with Appeal No. 26-1969. The court construes the appellants request to waive the appellate filing fees as a motion for leave to proceed on appeal in forma pauperis. The paperwork is incomplete because it does not include the required asset affidavit. Accordingly, the appellant shall either pay the $605.00 appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis in the district court by August 20, 2026. Failure to do so may result in the dismissal of this appeal. The clerk will send the appellant an asset affidavit form. Further, the motion to consolidate is DENIED. The mandate in appeal no. 26-1969 issued on June 22, 2026, and the appeal remains closed. The appellant is reminded that the district court no longer transmits the record on appeal to this court. Because the record is electronic, it is available for this courts use without the need for transmission of a physical record. The court will have electronic access to the complete record on appeal when it considers the merits of this appeal. Should appeal no. 26-2461 proceed to briefing, the appellant may make any arguments he believes have merit in his opening brief. Finally, the appellant shall file his overdue Circuit Rule 3(c) docketing statement by August 4, 2026. [ # 5 ] Sent Certified Mail. Receipt Number: 9589 07105270 1811 0032 70.
