ORDER re: 1. Motion to dismiss petition for review as untimely. 2. Response in opposition to respondents motion to dismiss the petition for review. [ # 4 ] [ # 5 ] Petitioner and respondent each shall file, on or before November 5, 2026, any supplemental papers they wish to submit in support of their positions on the pending motion to dismiss the petition as untimely. In particular, the government shall file a supplemental memorandum addressing, and expressly confirming or denying, petitioners assertion that the Board of Immigration Appeals denied a motion to reopen on July 31, 2026, and, if it confirms such an order exists, shall provide a copy of the order. From a preliminary review of the record, it appears that July 31, 2026, is less than 30 days before the petition for review was received by the United States District Court for the District of New Mexico on August 27, 2026before that court appears to have transferred the petition to the United States Court of Appeals for the Tenth Circuit, see 28 U.S.C. 1631regardless of the prison-mailbox rule, see Fed. R. App. P. 25(a)(2)(A)(iii); Chavarria-Reyes v. Lynch , 845 F.3d 275, 277 (7th Cir. 2016). A preliminary review of the certified administrative record also appears to suggest that an Immigration Judge denied a motion to reopen on July 31, 2026. If the government represents that the Board did not deny its own motion to reopen on that date, the government shall also address the timeliness and effectiveness of this petition with respect to the immigration judges order.
