Filing 3 Filed order (HARRY PREGERSON, WILLIAM C. CANBY and RAYMOND C. FISHER) Petitioner seeks review of a district court order denying with no explanation petitioners motion for an order withdrawing the reference of the adversary proceeding in bankruptcy court. Real Parties in Interest did not oppose the motion in the district court. Mandamus is the proper remedy to review the district courts order because no direct appeal may be taken under 28 U.S.C. 1291 from orders regarding the withdrawal of reference of a case to bankruptcy court. See In re Canter, 299 F.3d 1150, 1153 (9th Cir. 2002). Because this situation presents exceptional circumstances that warrant the extraordinary remedy of mandamus, the petition is granted. See Bauman v. United States Dist. Court, 557 F.2d 650 (9th Cir. 1977). The district courts November 3, 2011 order is hereby vacated. Within 60 days after the date of this order, the district court shall either enter an order withdrawing the reference of the adversary proceeding or issue an order setting forth the reasons for denying the motion, including whether the substance of the adversary proceeding complaint is a non-core proceeding and petitioner is entitled to a jury trial.
