CHRISTEN) We have reviewed the record and the opposition to the motion to dismiss, and we conclude that petitioner has failed to raise a colorable constitutional or legal claim to invoke our jurisdiction over this petition for review. See 8 U.S.C. 1252(a)(2)(D); Martinez-Rosas v. Gonzales, 424 F.3d 926 (9th Cir. 2005); Torres-Aguilar v. INS, 246 F.3d 1267, 1271 (9th Cir. 2001). Accordingly, the court dismisses this petition for review for lack of jurisdiction. See 8 U.S.C. 1182(i)(2), 1252(a)(2)(B); Corona-Mendez v. Holder, 593 F.3d 1143, 1146 (9th Cir. 2010). This dismissal is without prejudice to petitioners seeking prosecutorial discretion or deferred action from the Department of Homeland Security. See Reno v. American-Arab Anti-Discrimination Committee (AADC), 525 U.S. 471, 483-85 (1999) (stating that prosecutorial discretion by the agency can be granted at any stage, including after the conclusion of judicial review).
