September 21, 2017 Filing 3 Filed clerk order (Deputy Clerk: FG): The September 20, 2017 order is vacated as issued in error. The unopposed request by appellant Melvin Bundy in appeal No. 17-10396 to consolidate appeal Nos. 17-10394, 17-10395, 17-10396, 17-10397, 17-10398, 17-10399, 17-10402, and 17-10404 (Docket Entry No. [ # 10585454-2 ] in appeal No. 17-10396) is granted. The Clerk shall consolidate these appeals. The record reflects that these consolidated appeals are from the magistrate judges September 1, 2017 order denying appellants emergency motion for release. This court may lack jurisdiction over these appeals because appeals from orders relating to the release or detention of individuals charged with federal crimes are governed by 28 U.S.C. 1291, which provides that this court shall have jurisdiction over all final decisions of the district courts of the United States. See 28 U.S.C. 1291. The magistrate judges pretrial detention order therefore does not appear to be final for purposes of 1291 because it is subject to review by the district court. See 18 U.S.C. 3145(b); Fed. R. App. P. 9(a). Within 6 days after the date of this order, appellants shall show cause, either in one joint filing or in individual filings, why these consolidated appeals should not be dismissed for lack of jurisdiction or shall move for voluntary dismissal of these consolidated appeals. If appellants elect to show cause, appellee may file a reply within 3 days after service of any response. If any appellant does not comply with this order, the Clerk shall dismiss the relevant appeal pursuant to Ninth Circuit Rule 42-1. Briefing is suspending pending further order. If necessary, the court will set a briefing schedule upon resolution of this order to show cause.
