Filing 8 Filed order (STEPHEN REINHARDT, RICHARD A. PAEZ and CARLOS T. BEA) Appellants appeal the district courts September 22, 2017 order, which granted appellees renewed motion for judgment on the pleadings, insofar as those parties and claims were based only on Navajo and customary law, and which dismissed appellants complaint with leave to amend. We have reviewed the response to this courts October 27, 2017 order to show cause why this appeal should not be dismissed for lack of jurisdiction. We conclude that we lack jurisdiction to review the district courts order because it is not appealable as a final judgment or an order that comes within the collateral order doctrine. See 28 U.S.C. 1291; Coopers & Lybrand v. Livesay, 437 U.S. 463, 468 (1978); see also Chacon v. Babcock, 640 F.2d 221, 222 (9th Cir. 1981) (order is not appealable unless it disposes of all claims as to all parties or judgment is entered in compliance with Fed. R. Civ. P. 54(b)). Accordingly, this appeal is dismissed. DISMISSED. [10737260] (JBS) [Entered: 01/24/2018 03:34 PM] |
