Date Filed Document Text
August 2, 2019 Filing 12 Filed clerk order (Deputy Clerk: LCC): On July 9, 2019, this court issued an order staying appellate proceedings pending disposition of the motions for judgment as a matter of law and to alter judgment in the district court. A review of the record and appellants response to this courts July 9, 2019 order reflects that the district court has ruled on the post-judgment motions and, on July 17, 2019, entered an amended judgment. Accordingly, the stay is lifted, and this appeal shall proceed. Within 10 days after the date of this order, appellant shall designate any reporters transcripts or serve on appellee a statement indicating that appellant does not intend to order any transcripts. See 9th Cir. R. 10-3.1(a). If appellant designates transcripts, the transcripts will be due September 10, 2019. The opening brief and excerpts of record are due October 21, 2019; the answering brief is due November 20, 2019; and the optional reply brief is due within 21 days after service of the answering brief. July 9, 2019 Filing 7 Filed clerk order (Deputy Clerk: LCC): The courts records reflect that the notice of appeal was filed during the pendency of timely-filed motions listed in Federal Rule of Appellate Procedure 4(a)(4), and that those motions are still pending in the district court. The June 20, 2019 notice of appeal is therefore ineffective until entry of the order disposing of the last such motion outstanding. See Fed. R. App. P. 4(a)(4). Accordingly, proceedings in this court are held in abeyance pending the district courts resolution of the May 31, 2019 motion for judgment as a matter of law and the May 31, 2019 motion to alter judgment. See Leader Natl Ins. Co. v. Indus. Indem. Ins. Co., 19 F.3d 444, 445 (9th Cir. 1994). Within 14 days after the district courts ruling on the pending motions, appellant shall file a written notice in this court: (1) informing this court of the district courts ruling; and (2) stating whether appellant intends to prosecute this appeal. To appeal the district courts ruling(s) on the post-judgment motions, appellant must file an amended notice of appeal within the time prescribed by Federal Rule of Appellate Procedure 4. The Clerk shall serve this order on the district court. [11358772] (TSP) [Entered: 07/09/2019 08:13 PM]
