Although appellant has had three or more prior actions dismissed as frivolous, malicious, or for failure to state a claim upon which relief may be granted, appellant alleged that he faced imminent danger of serious physical injury at the time he filed his amended complaint and notice of appeal. See 28 U.S.C. 1915(g); Williams v. Paramo, 775 F.3d 1182, 1190 (9th Cir. 2015) (holding that a prisoner may meet this requirement by alleging that prison officials continue with a practice that has injured him or others similarly situated in the past, or that there is a continuing effect resulting from such a practice (brackets and internal quotation marks omitted)). Pursuant to 28 U.S.C. 1915(b)(1) and (2), however, appellant eventually must pay the full amount of the filing and docketing fees for this appeal. Appellants motion for appointment of counsel (Docket Entry No. [ # 6 ]) is denied. No motions for reconsideration, clarification, or modification of this denial shall be filed or entertained. The opening brief has been filed. The answering brief is due January 21, 2020. The optional reply brief is due within 21 days after service of the answering brief. Because appellant is proceeding without counsel, the excerpts of record requirement is waived. See 9th Cir. R. 30-1.2. Appellees supplemental excerpts of record are limited to the district court docket sheet, the notice of appeal, the judgment or order appealed from, and any specific portions of the record cited in the answering brief.
