HURWITZ) A review of the record and the parties responses to this courts July 29, 2019 order to show cause demonstrates that this court lacks jurisdiction over this appeal because the July 24, 2019 notice of appeal was not filed within 30 days after the district courts judgment entered on May 21, 2019. See 28 U.S.C. 2107(a); United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional); see also Bowles v. Russell, 551 U.S. 205 (2007) (court lacks authority to create equitable exceptions to jurisdictional requirement of timely notice of appeal); Aldabe v. Aldabe, 616 F.2d 1089, 1091 (9th Cir. 1980) (notice of appeal is timely filed if received by the district court within the applicable period specified in Fed. R. App. P. 4). Moreover, we cannot construe appellants response to this courts July 29, 2019 order to show cause to be a motion for an extension of time to appeal because such a motion would be untimely. See Fed. R. App. P. 4(a)(5)(A)(i) (motion must be filed within 30 days after the time to appeal expires); see also Malone v. Avenenti, 850 F.2d 569, 572 (9th Cir. 1988) (Rule 4(a)(5) requires a formal motion for extension of time to appeal). Consequently, this appeal is dismissed for lack of jurisdiction. DISMISSED.
