April 25, 2019 Filing 2 Filed clerk order (Deputy Clerk: DL): On April 11, 2019, appellant filed a pro se notice of appeal from the district courts order denying appellants motion to clarify sentence entered on October 11, 2018. Because the notice of appeal was not filed within 14 days after entry of the order, see Fed. R. App. P. 4(b)(1)(A), or within the additional 30 days provided in Federal Rule of Appellate Procedure 4(b)(4), this appeal appears to be untimely. On March 15, 2019, the district court denied appellants request for extension of time to file an appeal. Within 21 days after the date of this order, appellant shall file a motion for voluntary dismissal of this appeal or show cause in writing why it should not be dismissed for lack of a timely notice of appeal. Appellee may respond within 10 days after service of appellants memorandum. Failure to comply with this order shall result in the automatic dismissal of this appeal by the Clerk for failure to prosecute. See 9th Cir. R. 42-1.
