Filing 12 MANDATE ISSUED. (AWT, JSB and PJW) [11677665] (QDL) [Entered: 05/01/2020 09:23 AM] |
Filing 11 Filed order (A. WALLACE TASHIMA, JAY S. BYBEE and PAUL J. WATFORD) Patrick Joseph Soria appeals pro se from the district courts order denying his request for an order purging his civil contempt sanction. We have jurisdiction to determine our own jurisdiction. Havensight Capital LLC v. Nike, Inc., 891 F.3d 1167, 1171 (9th Cir. 2018). We dismiss for lack of appellate jurisdiction. We lack jurisdiction over this appeal because the district courts order denying Sorias request for an order purging contempt is an interlocutory order that is not immediately appealable. See Koninklijke Philips Elecs., N.V. v. KXD Tech., Inc., 539 F.3d 1039, 1042 (9th Cir. 2008) (The rule is settled in this Court that except in connection with an appeal from a final judgment or decree, a party to a suit may not review upon appeal an order fining or imprisoning him for the commission of a civil contempt. (citation and internal quotation marks omitted)); Branson v. City of Los Angeles, 912 F.2d 334, 336 (9th Cir. 1990) (denial of reconsideration of a non-appealable order is itself not appealable). All pending motions and requests are denied. DISMISSED. [11656093] (JMR) [Entered: 04/09/2020 09:30 AM] |
