Filing 15 Filed clerk order (Deputy Clerk: LCC): A review of the record and the response to this courts October 9, 2019 order reflects that the district court has granted the post-judgment motion and that an amended notice of appeal has been filed to include the order granting the post-judgment motion. Accordingly, the notice of appeal is so amended, and this appeal shall proceed. A review of the record further reflects that the district court entered an amended judgment on November 8, 2013, and that appellants have appealed that amended judgment in appeal No. 19-56320. Accordingly, it appears that this appeal is duplicative of appeal No. 19-56320. Within 21 days after the date of this order, appellants shall move for voluntary dismissal of this appeal or show cause why it should not be dismissed as duplicative. If appellants elect to show cause, a response may be filed within 10 days after service of the memorandum. If appellants do not comply with this order, the Clerk shall dismiss this appeal pursuant to Ninth Circuit Rule 42-1. Briefing in this appeal remains suspended pending further order of the court. Filing 2 Filed clerk order (Deputy Clerk: CJ): The courts records reflect that the notice of appeal was filed during the pendency of a timely filed motion listed in Federal Rule of Appellate Procedure 4(a)(4). The notice of appeal is therefore ineffective until entry of the order disposing of the last such motion outstanding. See Fed. R. App. P. 4(a)(4). Accordingly, appellate proceedings other than mediation shall be held in abeyance pending the district courts resolution of the pending motion. See Leader Nat'l Ins. Co. v. Indus. Indem. Ins. Co., 19 F.3d 444, 445 (9th Cir. 1994). Within 7 days after the district courts ruling on the pending motion, appellants shall notify this court in writing of the ruling and shall advise whether appellants intend to prosecute this appeal. To appeal the district courts ruling on the post-judgment motion, appellants must file an amended notice of appeal within the time prescribed by Federal Rule of Appellate Procedure 4. The Clerk shall serve this order on the district court. [11459839] (JMR) [Entered: 10/09/2019 03:21 PM] |
