January 23, 2020 Filing 8 Filed clerk order (Deputy Clerk: DA): On December 23, 2019, appellant filed a request in the district court to withdraw this preliminary injunction appeal, which was forwarded to this court. Appellant subsequently paid the fees for this appeal and filed a motion to stay in the district court, indicating he intends to prosecute this preliminary injunction appeal. Accordingly, appellants motion to voluntarily dismiss this preliminary injunction appeal is denied (Docket Entry No. [ # 5 ] ), without prejudice to renewal. The court has received appellants letter requesting information regarding the record for this appeal. A review of the record reflects that the district court has not held any hearings in this action. Accordingly, there are no transcripts required for the appeal. Because appellant is proceeding without counsel, the excerpts of record requirement is waived. See 9th Cir. R. 30-1.2. Appellant does not need to provide a copy of the district court record to this court. If appellant requires copies of district court dockets to prepare his opening brief, he may request them in writing from the district court. The motion to extend time to file the opening brief is granted. The opening brief is due March 25, 2019. Failure to file timely the opening brief shall result in the automatic dismissal of this appeal by the Clerk for failure to prosecute. See 9th Cir. December 24, 2019 Filing 2 Filed clerk order (Deputy Clerk: DA): The appeal filed December 20, 2019 is a preliminary injunction appeal. Accordingly, Ninth Circuit Rule 3-3 shall apply. The briefing schedule shall be established as follows: appellants opening brief is due January 21, 2020. As there are no appearances for the appellees, briefing will be deemed completed upon the filing of appellants opening brief. The appeal and any motions pending at the time briefing is completed shall be referred to the next available motions panel for disposition. A review of this courts docket reflects that the filing and docketing fees for this appeal remain due. Within 21 days after the date of this order, appellant shall pay to the district court the $505.00 filing and docketing fees for this appeal and file in this court proof of such payment or file in this court a motion to proceed in forma pauperis.
