See 8 U.S.C. 1252(b)(1); Sheviakov v. INS, 237 F.3d 1144 (9th Cir. 2001); Narayan v. INS, 105 F.3d 1335 (9th Cir. 1997). A review of the record also suggests that this court may lack jurisdiction over this petition for review because this court lacks jurisdiction to review a negative credible fear determination in expedited removal proceedings. See 8 U.S.C. 1252(a)(2)(A); Pena v. Lynch, 815 F.3d 452 (9th Cir. 2016). Within 21 days after the filing date of this order, petitioner shall move for voluntary dismissal of the petition for review or show cause why it should not be dismissed for lack of jurisdiction. If petitioner elects to show cause, respondent may respond within 10 days after service of petitioners memorandum. Failure to comply with this order will result in the automatic dismissal of this petition for review by the Clerk for failure to prosecute and the expiration of the temporary stay of removal confirmed by Ninth Circuit General Order 6.4(c). See 9th Cir. R. 42-1. The certified administrative record remains due March 12, 2019. The response to the stay motion is stayed pending further order of this court.
