January 30, 2019 Filing 6 Filed clerk order (Deputy Clerk: KML) A review of the record suggests that this court may lack jurisdiction over this petition for review because the court has been unable to locate a final order of removal issued by the agency. See, e.g., 8 U.S.C. 1252(a)(1); Lopez-Ruiz v. Ashcroft, 298 F.3d 886, 887 (9th Cir. 2002) (order) (the court has jurisdiction to review only final orders of removal). The petition refers to a January 17, 2019 order of the Board of Immigration Appeals, but petitioner has not provided a copy of that order. See 9th Cir. R. 15-4. Further, the alien registration number provided in the petition does not appear to correspond to this petitioner. Within 28 days after the date of this order, petitioner shall file a statement explaining why this petition should not be dismissed for lack of jurisdiction. Petitioner shall also include a copy of the final order of removal challenged in this petition for review and provide his correct alien registration number. The government may file a response within 10 days after service of petitioners statement. If petitioner does not respond to this order, the petition for review may be dismissed by the Clerk for failure to prosecute. See 9th Cir. R. 42-1. If the petition is dismissed, the temporary stay of removal will be terminated. See 9th Cir. Gen. Ord. 6.4(c)(1)(3). Also within 28 days after the date of this order, the government shall file a copy of any final order of removal that may be the subject of this petition, including any reinstatement order, or a statement that it is unable to locate any such order. Alternatively, the government may file the certified administrative record (CAR). If the government does not file the CAR within 21 days after the date of this order, it remains due March 19, 2019. The response to the stay motion remains due April 16, 2019. If necessary, the court will set a briefing schedule for this petition upon disposition of this order and all other pending motions.[11172370] (WL) [Entered: 01/30/2019 09:22 AM]
