Filing 3 Filed order (DIARMUID F. O'SCANNLAIN, WILLIAM A. FLETCHER and PAUL J. WATFORD): Petitioner has not demonstrated that this case warrants the intervention of this court by means of the extraordinary remedy of mandamus. See Bauman v. U.S. Dist. Court, 557 F.2d 650 (9th Cir. 1977). Discovery requests generally need not be filed in the district court. See, e.g., S.D. Cal. Civ. R. 33.1(c). Even without filing, discovery requests remain effective to require an answer by the responding party, provided the requests comply with the applicable Federal Rule(s) of Civil Procedure and local court rules. See, e.g., Fed. R. Civ. P. 33, 34. Accordingly, the petition is denied. The motion to proceed in forma pauperis (Docket Entry No. [ # 2 ]) is denied as moot. No further filings will be entertained in this closed petition. DENIED. [11276139] (AF) [Entered: 04/24/2019 03:57 PM] |
