Filing 3 Filed order (RICHARD A. PAEZ, JACQUELINE H. NGUYEN and ANDREW D. HURWITZ) A review of the district court docket reflects that on July 18, 2019, the district court dismissed No. 2:19-cv-00265-R-SS for lack of prosecution. However, no separate judgment was entered, and the motion to set aside dismissal, filed on July 29, 2019, remains pending. Petitioner therefore has not demonstrated that this case warrants the intervention of this court by means of the extraordinary remedy of mandamus. See Bauman v. U.S. Dist. Court, 557 F.2d 650, 654-55 (9th Cir. 1977) (The party seeking the writ has no other adequate means, such as a direct appeal, to attain the relief he or she desires.). Accordingly, the petition is denied. The motion to proceed in forma pauperis (Docket Entry No. [ # 2 ]) is denied as moot. No further filings will be entertained in this closed case. DENIED.
