Sproulss response to the courts January 10, 2019 order to show cause why he should not be reciprocally suspended based on his six-month suspension from the practice of law in the State of California, effective January 11, 2019. Respondent Sprouls consents to a concurrent reciprocal six-month suspension in this court. See 9th Cir. R. 46-2(e). Accordingly, respondent is hereby removed from the roll of attorneys admitted to practice before this court. See Fed. R. App. P. 46(c); 9th Cir. R. 46-2; In re Rosenthal, 854 F. 2d 1187 (9th Cir. 1988). The Clerk shall amend this courts records to so reflect. At the conclusion of his suspension, Sprouls may petition for reinstatement to the bar of the Ninth Circuit pursuant to Ninth Circuit Rule 46-2(h). Sprouls shall file the petition using this docket number and include a showing that he is a member in good standing of the California bar. The Clerk shall serve this order on the State Bar of California Enforcement Department, 845 S. Figueroa Street, Los Angeles, California 90017-2515. January 10, 2019 Filing 2 Filed order (Appellate Commissioner): The court is informed that the Supreme Court of California has suspended respondent Frank P. Sprouls, Esq., from the practice of law for six months, effective January 11, 2019. Within 28 days after the date of this order, respondent shall: (1) resign from the bar of this court; or (2) agree to a concurrent reciprocal suspension from the bar of this court; or (3) show cause in writing why he should not be reciprocally suspended from the bar of this court and ordered to withdraw from any pending case in which he is the sole counsel of record. See In re Rosenthal, 854 F.2d 1187 (9th Cir. 1988). Court records reflect that respondent remains the sole counsel of record in Turcios-Navarro v. Whitaker, No. 18-71099. Upon consideration of the response to this order and after a hearing, if requested, the court will determine whether to order respondent reciprocally suspended. See Fed. R. App. P. 46(c); 9th Cir. R. 46-2(c). If an attorney is registered for the Courts Electronic Case Filing System (Appellate ECF) and is suspended or disbarred, the attorneys Appellate ECF account will also be suspended (locked) until the attorney has been reinstated to the bar of this court. Failure to respond to this order in a timely fashion will result in the removal of respondent from the roll of attorneys admitted to practice before this court without further notice.
