Filing 9 Filed original and 0 copies of Appellant Jeremy Vaughn Pinson opening brief of 6 pages (Informal: Yes). Served on 03/10/2020. [11671486] (KT) [Entered: 04/24/2020 04:24 PM] |
Filing 8 Filed order (MARY H. MURGUIA, JOHN B. OWENS and MARK J. BENNETT) Appellants motion for appointment of counsel (Docket Entry No. [ # 5 ]) is denied. No motions for reconsideration, clarification, or modification of this denial shall be filed or entertained. We conclude that appellant has had at least three prior actions or appeals dismissed for a qualifying reason under 28 U.S.C. 1915(g). See Stine & Pinson v. John Doe, No. 14-6160 (4th Cir. Apr. 29, 2014) (dismissing appeal as frivolous); Pinson v. Lappin, No. 11-1099 (10th Cir. Sept. 21, 2011) (dismissing appeal for failure to prosecute after concluding that appeal was frivolous); Pinson v. Chipi, No. 10-12235 (11th Cir. Feb. 2, 2011) (dismissing appeal as frivolous). However, appellants filings demonstrate that appellant has alleged imminent danger of serious physical injury.... Accordingly, appellants motion to proceed in forma pauperis (Docket Entry No. [ # 3 ]) is granted. See 28 U.S.C. 1915(a). Because appellant is a prisoner, appellant must pay the $505 filing and docketing fees over time, if appellant wants this appeal to go forward. See 28 U.S.C. 1915(b)(1), (2). If appellant wants to pay the $505 over time to allow this appeal to go forward, appellant must, within 21 days after the date of this order... If appellant does not file the completed authorization form with the court within 21 days after the date of this order, the Clerk will dismiss the appeal for failure to prosecute. See 9th Cir. R. 42-1.The Clerk shall file the opening brief received on March 23, 2020 (Docket Entry No. [ # 4 ]). Because there is no appearance by appellees, briefing will be completed upon the filing of the opening brief. The Clerk shall serve this order and a prisoner authorization form on appellant.
