Date Filed Document Text
February 21, 2021 Filing 6 Filed (ECF) Appellant Tatyana Evgenievna Drevaleva response to order to show cause dated 02/01/2021. Date of service: 02/21/2021. [12010771] [20-17523] (Drevaleva, Tatyana) [Entered: 02/21/2021 03:38 PM]
February 1, 2021 Filing 5 Filed clerk order (Deputy Clerk: MF): On January 7, 2021, this court issued a referral notice requesting the district court to determine whether appellants in forma pauperis status should continue on appeal or whether the appeal is frivolous or taken in bad faith. On January 12, 2021, appellant paid the docketing and filing fees for this appeal. The district court therefore issued on order on January 25, 2021 finding the limited referral unnecessary. The Clerk has updated the docket to reflect that the fees have been paid. A review of the record suggests that this appeal may be appropriate for summary disposition under Ninth Circuit Rule 3-6(b) because it does not appear that the district court erred in dismissing the complaint as barred by judicial immunity. See United States v. Hooton, 693 F.2d 857, 858 (9th Cir. 1982) (stating standard for summary affirmance). Within 21 days after the filing date of this order, appellant shall show cause why summary affirmance of the district courts judgment is not appropriate. If appellant does not comply with this order, this appeal will be automatically dismissed by the Clerk for failure to prosecute. See 9th Cir. R. 42-1. The briefing schedule is stayed pending further order of the court. [11988505] (CKP) [Entered: 02/01/2021 02:50 PM]
January 28, 2021 Filing 4 Received copy of District Court order filed on 01/25/2021. The Court consequently would have revoked Drevalevas IFP status for her appeal because her action has no arguable basis in fact or law, but it appears that step is unnecessary now that Drevaleva has paid the $505.00 filing fee for her appeal. Dkt. No. 40. [11984020] (RR) [Entered: 01/28/2021 06:01 AM]
January 13, 2021 Filing 3 Received notification from District Court re: payment of docket fee. Amount Paid: USD 505.00. Date paid: 01/12/2021. [11962321] (RT) [Entered: 01/13/2021 12:46 PM]
January 7, 2021 Filing 2 Filed referral notice (Deputy Clerk:CKP): Referring to the district court for determination whether in forma pauperis status should continue for this appeal. [11955235] (CKP) [Entered: 01/07/2021 09:04 AM]
December 31, 2020 Filing 1 DOCKETED CAUSE AND ENTERED APPEARANCE OF PRO SE APPELLANT AND NO APPEARANCE FOR APPELLEES. SEND MQ: No. The schedule is set as follows: Appellant Tatyana Evgenievna Drevaleva opening brief due 02/22/2021. [11949640] (JMR) [Entered: 12/31/2020 10:51 AM]
