Filing 6 Filed Appellant Kenneth Gregory Williams motion for reconsideration. Deficiencies: Mandate issued. Served on 08/17/2020. [11800882] (RL) [Entered: 08/24/2020 04:29 PM] |
Filing 5 MANDATE ISSUED. (SRT, MMS and CMC) [11788966] (QDL) [Entered: 08/14/2020 08:57 AM] |
Filing 4 Filed order (SIDNEY R. THOMAS, MARY M. SCHROEDER and CONSUELO M. CALLAHAN) A review of the record demonstrates that this court lacks jurisdiction over this appeal because the notice of appeal, served on June 11, 2020 and filed on June 17, 2020, was not filed or delivered to prison officials within 60 days after the district courts judgment entered on March 30, 2018. See 28 U.S.C. 2107(b); United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional); see also Fed. R. App. P. 26(b)(1) (court of appeal may not extend time to file a notice of appeal except as authorized in Fed. R. App. P. 4); Fed. R. App. P. 4(a)(6)(B) (motion to reopen time to appeal must be filed within 180 days after entry of the judgment or within 14 days after receiving notice of the entry of judgment, whichever is earlier); In re Stein, 197 F.3d 421, 425 (9th Cir. 2000) (Fed. R. App. P. 4(a)(6) is exclusive means for extending time to appeal based on lack of notice and district courts lack discretion to grant motions to reopen that fall outside the time limits under Fed. R. App. P. 4(a)(6)). Consequently, this appeal is dismissed for lack of jurisdiction. DISMISSED. [11764269] (OC) [Entered: 07/23/2020 04:08 PM] |
Filing 3 Received PLRA authorization response from appellant. Dated 07/07/2020. [Fee status not updated.] [11751277] (QDL) [Entered: 07/13/2020 04:25 PM] |
Filing 2 Filed Appellant Kenneth Gregory Williams letter dated 06/11/2020 re: copy of notice of appeal dated 6/11/20. Paper filing deficiency: None. [11729421] (CW) [Entered: 06/22/2020 02:11 PM] |
