Filing 6 Filed order (BARRY G. SILVERMAN, M. MARGARET MCKEOWN and DANIEL A. BRESS) : Appellants motion to proceed in forma pauperis is granted (Docket Entry No. [ # 5 ] ). The Clerk will update the docket accordingly. Appellants motion for appointment of counsel (Docket Entry No. [ # 2 ] ) is granted. See 18 U.S.C. 3006A(a)(2)(B); Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983). Counsel will be appointed by separate order. The Clerk will electronically serve this order on the appointing authority for the Western District of Washington, who will locate appointed counsel. The appointing authority must send notification of the name, address, and telephone number of appointed counsel to the Clerk of this court at counselappointments@ca9.uscourts.gov within 14 days of locating counsel. The opening brief is due November 30, 2020; the answering brief is due December 30, 2020; the optional reply brief is due within 21 days after service of the answering brief. On March 30, 2020, the district court denied appellants motion to vacate, set aside, or reduce sentence under 28 U.S.C. 2255, and entered judgment. The March 30, 2020 order granted a certificate of appealability (COA). On June 16, 2020 the district court entered a post-judgment order granting a motion to extend time to file a motion for reconsideration of the March 30, 2020 order, denying reconsideration, and denying a request to construe a previously filed request for a COA as a notice of appeal. On June 26, 2020, appellant filed in the district court a notice of appeal challenging both the March 30, 2020 judgment and the June 16, 2020 post-judgment order. In addition to the issue certified for appeal by the district court in its March 30, 2020 order, the parties briefs must also address whether this court has jurisdiction to review the March 30, 2020 judgment. This order authorizes production of transcripts at government expense. See 28 U.S.C. 753(f). Appellant must provide a copy of this order to the reporter(s) along with the designation.
