If appellants do not comply with this order, the Clerk shall dismiss appellants appeal of the March 16 Order pursuant to Ninth Circuit Rule 42-1. April 17, 2020 Filing 3 Filed clerk order (Deputy Clerk: SZ) : This appeal challenges: (1) the district courts March 10, 2020 order denying appellants motion to dissolve the preliminary injunction; (2) the district courts March 16, 2020 order authorizing the receiver to sell property; and, (3) the district courts March 31, 2020 contempt order. A review of the record suggests that this court may lack jurisdiction to review some or all of these orders. sz/MOATT 2 20-55397 The court may lack jurisdiction to review the March 10, 2020 order because an order denying a motion to modify or dissolve an injunction is appealable only if the motion raised new matter not considered at the time of the original injunction. See Gon v. First State Ins. Co., 871 F.2d 863, 865-66 (9th Cir. 1989). The court may lack jurisdiction to review the March 16, 2020 order authorizing the receiver to sell property because the court only has jurisdiction over appeals which deny such authorization. See 28 U.S.C. 1292(a)(2) (the court has jurisdiction over appeals from [i]nterlocutory orders refusing orders to take steps to accomplish the purposes [of the receivership], such as directing sales or other disposals of property); see also SEC v. Am. Principals Holdings, Inc., 817 F.2d 1349, 1351 (9th Cir. 1987) (jurisdiction under 28 U.S.C. 1292(a)(2) is narrowly interpreted and restricted to orders that refuse to take steps to accomplish purpose of receivership). The court may lack jurisdiction to review the March 31, 2020 order because an order of civil contempt entered against a party to ongoing litigation is generally not immediately appealable. See Koninklijke Philips Elecs. N.V. v. KSD Tech., Inc., 539 F.3d 1039, 1042 (9th Cir. 2008). Within 14 days after the date of this order, appellants shall move for voluntary dismissal of this appeal or show cause why it should not be dismissed for lack of jurisdiction or limited in scope. If appellants elect to show cause, a response may be filed within 7 days after service of the memorandum. If appellants do not comply with this order, the Clerk shall dismiss this appeal pursuant to Ninth Circuit Rule 42-1. Briefing is suspended pending further order of the court.
