September 7, 2020 Filing 3 Filed order (DIARMUID F. O'SCANNLAIN and JOHNNIE B. RAWLINSON) This petition for a writ of mandamus raises issues that warrant an answer. See Fed. R. App. P. 21(b). The bench trial scheduled for September 8, 2020 is temporarily stayed pending further court order. Within 7 days after the date of this order, Bank of New York Mellon shall file an answer to the petition and a response to the emergency stay motion. In particular, the answer and response shall address whether the district courts March 3, 2020 order is consistent with Solis v. County. of Los Angeles, 514 F.3d 946, 955 (9th Cir. 2008) (When a party properly files a jury demand under the requirements of Rule 38(b), he has satisfied all that is required by the Rules to avoid waiver, and his jury demand may not be withdrawn without the consent of the parties.). The district court, also within 7 days after the date of this order, may address the petition and/or emergency stay motion if it so desires. The district court may elect to file an answer with this court or to issue a supplemental order and serve a copy on this court.
