BYBEE) A review of the record demonstrates that this court lacks jurisdiction over this appeal because the September 17, 2021 order challenged in the appeal is not final or appealable. See 28 U.S.C. 1291; Land v. Deeds, 878 F.2d 318 (9th Cir. 1989) (denial of bail pending a decision on a habeas corpus petition is not appealable); Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983) (denial of appointment of counsel in a habeas proceeding is not appealable). Consequently, this appeal is dismissed for lack of jurisdiction. We construe this appeal in part as a petition for writ of mandamus challenging the district courts denial of the motion for bail. See United States v. McCandless, 841 F.3d 819, 82123 (9th Cir. 2016) (construing appeal of order denying bail pending resolution of a habeas petition as a petition for writ of mandamus, and holding that because defendant failed to show the district court clearly erred in denying bail mandamus relief was unwarranted not appealable).
