| Filing 3 Filed order (SANDRA S. IKUTA, JOHN B. OWENS and MARK J. BENNETT) This court has reviewed the notice of appeal and accompanying documents filed October 13, 2021 in the above-referenced district court docket pursuant to the pre-filing review order entered in docket No. 14-80179. Appeal No. 21-56158 shall be permitted to proceed. Appellants request for an extension of time to file a statement of issues on appeal is denied as unnecessary. Appellant may raise his arguments in the opening brief. The court will consider only the arguments appellant specifically and distinctly includes in his opening brief. See Arpin v. Santa Clara Valley Transp. Agency, 261 F.3d 912, 919 (9th Cir. 2001). Appellant shall designate the reporters transcript by December 13, 2021. The transcript is due January 12, 2021. The opening brief is due February 21, 2022; the answering brief is due March 23, 2022; and the optional reply brief is due within 21 days after service of the answering brief. Because appellant is proceeding without counsel, appellant is not required to file excerpts of record. See 9th Cir. R. 30-1.3. If appellant does not file excerpts of record, appellees must file Supplemental Excerpts of Record that contain all of the documents that are cited in the pro se opening brief or otherwise required by Rule 30-1.4, as well as the documents that are cited in the answering brief.
