Filing 2 Filed clerk order (Deputy Clerk: KG): The court sua sponte consolidates Appeal Nos. 22-10038 and 22-10039. Court records show that counsel Rustam A. Barbee, Esq., was appointed under the Criminal Justice Act to represent appellant before the district court and has not been granted leave to withdraw. Counsel has a duty to continue to represent appellant on appeal until counsel is relieved by this court. See 9th Cir. R. 4-1(a). Therefore, although appellant filed pro se notices of appeal, counsel Barbee remains responsible for prosecuting these consolidated appeals and has been entered on the docket as counsel of record. If counsel wishes to withdraw, within 21 days of this order, he must file in this court a motion to withdraw that complies with the requirements of Ninth Circuit Rule 4-1(c). If counsel does not move to withdraw, the existing briefing schedule will remain in effect for these consolidated appeals.
