Filing 3 Filed order (JOHN B. OWENS, KENNETH K. LEE and PATRICK J. BUMATAY) This court has reviewed the notice of appeal and accompanying documents served April 20, 2022, and filed May 2, 2022, in the above-referenced district court docket pursuant to the pre-filing review order entered in docket No. 08-80084. Appeal No. 22-15681 shall be permitted to proceed. A review of this courts docket reflects that the filing and docketing fees for this appeal remain due. Within 21 days after the date of this order, appellant shall pay to the district court the $505.00 filing and docketing fees for this appeal and file in this court proof of such payment or file in this court a motion to proceed in forma pauperis. Failure to pay the fees or file a motion to proceed in forma pauperis will result in the automatic dismissal of the appeal by the Clerk for failure to prosecute. See 9th Cir. R. 42-1. The opening brief is due August 22, 2022. Because there are no appearances by appellees, briefing will be completed upon the filing of the opening brief. The filing of a motion to proceed in forma pauperis will automatically stay the briefing schedule under Ninth Circuit Rule 27-11.
