| Filing 5 Filed clerk order (Deputy Clerk: DA): Appellants notice of appeal filed in the district court on November 14, 2022 appears to challenge the district courts order dated November 3, 2022 and entered on November 4, 2022. Among other things, the district courts November 4, 2022 order granted a motion for summary judgment as to some parties, denied several of appellants motions for preliminary injunction, and stayed a decision as to two of appellants motions for preliminary injunction. The November 14, 2022 notice of appeal states appellant is appealing the district courts decision on defendants-appellees motion for summary judgment. However, it appears that the only the portion of the November 4, 2022 order that may be immediately appealable is the portion denying appellants motions for preliminary injunctive relief. See 28 U.S.C. 1292(a)(1); see also 28 U.S.C. 1291; Chacon v. Babcock, 640 F.2d 221, 222 (9th Cir. 1981) (order is not appealable unless it disposes of all claims as to all parties or judgment is entered in compliance with rule). Within 21 days after the date of this order, appellant must show cause why this appeal should not be dismissed, or limited in scope to the portion of the November 4, 2022 order that denied appellants motions for preliminary injunctive relief. See 28 U.S.C. 1292(a)(1). If appellant elects to show cause, appellees may file a response within 10 days after service of the memorandum. If appellant does not comply with this order, the Clerk will dismiss this appeal pursuant to Ninth Circuit Rule 42-1. A briefing schedule will be set, if necessary, upon disposition of this order to show cause and appellants pending motions to proceed in forma pauperis and for appointment of counsel.
