Filing 2 Filed order (KIM MCLANE WARDLAW, RICHARD R. CLIFTON and GABRIEL P. SANCHEZ): This court has reviewed the notice of appeal filed December 9, 2022 in the above-referenced district court docket pursuant to the pre-filing review order entered in docket No. 15-80223. Because this court lacks jurisdiction over this appeal of the district courts November 21, 2022 order, the appeal will not be permitted to proceed. See 28 U.S.C. 1291; WMX Techs., Inc. v. Miller, 104 F.3d 1133, 1136 (9th Cir. 1997) (en banc) (dismissal of complaint with leave to amend is not appealable); Bishop v. Bechtel Power Corp. (Estate of Bishop), 905 F.2d 1272, 1274-75 (9th Cir. 1990) (order denying motion to remand to state court is not an appealable collateral order). Appeal No. 22-16990 is therefore dismissed. This order, served on the district court for the District of Arizona, will constitute the mandate of this court.
