May 22, 2023 Filing 18 MANDATE ISSUED A. Wallace TASHIMA, Sidney R. THOMAS, Lucy H. KOH [Entered: 05/22/2023 10:16 AM]
March 30, 2023 Opinion or Order Filing 17 ORDER FILED. A. Wallace TASHIMA, Sidney R. THOMAS, Lucy H. KOH Petitioner seeks review of an order of the Board of Immigration Appeals (BIA) upholding an immigration judges denial of asylum, withholding of removal, and protection under the Convention Against Torture (CAT). Substantial evidence supports the agencys adverse credibility determination based on the totality of the circumstances, and we deny the petition for review as to petitioners asylum and withholding of removal claims. See Shrestha v. Holder, 590 F.3d 1034, 1048 (9th Cir. 2010). Substantial evidence also supports the agencys denial of CAT protection because it was based on the same evidence found not credible, and petitioner does not point to other evidence in the record that compels the conclusion that it is more likely than not he would be tortured by or with the consent or acquiescence of the government if returned to El Salvador. See id. at 1048-49. The governments motion for summary disposition (Docket Entry No. 10) is granted because the questions on review are too insubstantial to warrant full briefing. See 9th Cir. R. 3-6(a) (standard for summary disposition). The temporary stay of removal remains in place until the mandate issues. The motion for a stay of removal is otherwise denied. PETITION FOR REVIEW DENIED. [Entered: 03/30/2023 03:36 PM]
