Date Filed Document Text
October 12, 2023 Opinion or Order Filing 17 ORDER FILED. (Sidney R. THOMAS, M. Margaret McKEOWN, Andrew D. HURWITZ) Petitioner seeks review of an order of the Board of Immigration Appeals (BIA) affirming without opinion an immigration judges denial of her motion to terminate removal proceedings. Petitioners contention that her notice to appear violated a claim-processing rule is not properly before the court because she failed to raise it before the BIA. See Umana-Escobar v. Garland, 69 F.4th 544, 550 (9th Cir. 2023) (Because . . . Umana-Escobar failed to exhaust the alleged claim-processing violation as required under 8 U.S.C. 1252(d)(1), we deny this portion of the petition.); see also Santos-Zacaria v. Garland, 598 U.S. 411, 417-19 (2023) (section 1252(d)(1) is a non-jurisdictional claim-processing rule). The motion for summary disposition (Docket Entry No. 15) is granted because the questions on review are too insubstantial to warrant full briefing. See 9th Cir. R. 3-6(a) (standard for summary disposition); see also United States v. Hooton, 693 F.2d 857, 858 (9th Cir. 1982). PETITION FOR REVIEW DENIED. [Entered: 10/12/2023 09:58 AM]
