Date Filed Document Text
July 12, 2022 Filing 3 Filed order (BARRY G. SILVERMAN, CONSUELO M. CALLAHAN and DANIEL P. COLLINS) This court has reviewed the notices of appeal filed May 19, 2022, June 7, 2022, and June 14, 2022, in the above-referenced district court docket pursuant to the pre-filing review order entered in docket No. 92-80350. Because the appeals of the district courts May 10, 2022 judgment and June 3, 2022 post-judgment order are so insubstantial as to not warrant further review, the appeals will not be permitted to proceed. See In re Thomas, 508 F.3d 1225 (9th Cir. 2007). Appeals No. 22-35452 and 22-35453 are therefore dismissed. Appellants May 19, 2022 notice of appeal includes an alternative request for a writ of mandamus. Because appellant has not demonstrated that this case warrants the intervention of this court by means of the extraordinary remedy of mandamus, it will not be permitted to proceed as a petition for writ of mandamus. See Bauman v. U.S. Dist. Court, 557 F.2d 650 (9th Cir. 1977); In re Thomas, 508 F.3d at 1227. This order, served on the district court for the Western District of Washington, will constitute the mandate of this court for appeals No. 22-35452 and 22-35453. No motions for reconsideration, rehearing, clarification, stay of the mandate, or any other submissions will be filed or entertained. DISMISSED in part; DENIED in part. [12491812] (OC) [Entered: 07/12/2022 11:57 AM]
July 6, 2022 Filing 2 Received copy of amended notice of appeal from district court. [12487039] (JFF) [Entered: 07/06/2022 09:07 AM]
June 9, 2022 Filing 1 DOCKETED CAUSE AND ENTERED APPEARANCE OF PRO SE APPELLANT AND NO APPEARANCE FOR APPELLEES. This appeal is subject to a pre-filing review order in case number 92-80350. The appeal will be reviewed by the Court to determine whether it will be allowed to proceed. No briefing schedule will be set until/unless the Court determines that the appeal should be allowed to proceed. [12467379] (RT) [Entered: 06/09/2022 11:06 AM]
