August 30, 2022 Filing 3 Filed clerk order (Deputy Clerk: MM): Court records show that counsel Donald Nguyen, Esq., and Aaron Spolin, Esq., were retained to represent appellant before the district court and have not been granted leave to withdraw. Counsel have a duty to continue to represent appellant on appeal until counsel are relieved by this court. See 9th Cir. R. 4-1(a). Therefore, although appellant filed a pro se notice of appeal, counsel Nguyen and Spolin remain responsible for prosecuting this appeal and have been entered on the docket as counsel of record. If counsel wish to withdraw, within 21 days of this order, they must file a motion in this court, which must be accompanied by one of the following: (1) a substitution of counsel showing that new counsel has been retained and has filed a notice of appearance, and paid to the district court the $505.00 filing and docketing fees for these appeals; (2) a motion to appoint counsel, accompanied by a completed financial affidavit (CJA Form 23); (3) a statement expressing appellants clear and unequivocal request that the court exercise its discretion to permit appellant to proceed on appeal without the assistance of counsel, see 9th Cir. R. 4-1(d); Martinez v. Court of Appeal, 528 U.S. 152 (2000); or (4) an affidavit or signed statement from appellant showing that appellant has been advised of his rights with regard to these appeals and expressly stating that appellant wishes to dismiss the appeals voluntarily, see 9th Cir. R. 27-9.1. See 9th Cir. R. 4-1(c). If counsel do not file a motion to withdraw, the following briefing schedule will govern: appellant must designate the reporters transcript by September 21, 2022. The transcript is due October 21, 2022. The opening brief and excerpts of record are due November 30, 2022; the answering brief is due December 30, 2022; and the optional reply brief is due within 21 days after service of the answering brief.
