ERICKSEN): Upon a review of the record, it is not apparent whether there is federal jurisdiction under 28 U.S.C. 1332, particularly in view of plaintiff naming as a defendant Barrett Daffin Frappier Treder & Weiss, LLP, a citizen of California. Because the district court did not rule on the question of fraudulent joinder, and because defendants argument that Barrett was fraudulently joined may require additional factual development, we issue a limited remand so that the district court can determine whether there is diversity jurisdiction in this case. In the course of the limited remand, and to the extent the district court concludes there is diversity jurisdiction, the district court may clarify and re-evaluate whether its dismissal order of January 26, 2022 extended to those defendantsNationstar Mortgage LLC, Mortgage Electronic Registration Systems, Inc. (MERS), and Federal National Mortgage Association (Fannie Mae)who answered the complaint instead of moving to dismiss.1 This Court retains jurisdiction over this case during this limited remand.
