The application for authorization to file a second or successive 28 U.S.C. 2255 motion in the district court is denied. The applicant has not made a prima facie showing under 28 U.S.C. 2255(h) of: (1) newly discovered evidence that, if proven and viewed in light of the evidence as a whole, would be sufficient to establish by clear and convincing evidence that no reasonable factfinder would have found the movant guilty of the offense; or (2) a new rule of constitutional law, made retroactive to cases on collateral review by the Supreme Court, that was previously unavailable. See United States v. Eckford, F.4th , No. 17-50167, 2023 WL 5210863, at *7 (9th Cir. Aug. 15, 2023) (United States v. Taylor, 142 S. Ct. 2015 (2022), does not undermine this courts caselaw holding that completed Hobbs Act robbery and aiding and abetting Hobbs Act robbery are crimes of violence under 18 U.S.C. 924(c)); see also United States v. Major, No. 17-16764, 2022 WL 1714290, at *1 (9th Cir. May 27, 2022) (It is apparent from the record that Majors 924(c) convictions are predicated on Hobbs Act robbery, not conspiracy to commit Hobbs Act robbery.).
