Filing 2 Filed order (Appellate Commissioner): The notice of appeal filed July 30, 2023, challenges the district courts judgment entered on July 7, 2022, and the district courts post-judgment orders entered on July 10, 2023. Appellant previously appealed the district courts judgment entered on July 7, 2022. The portion of this appeal challenging the district courts judgment entered on July 7, 2022 is therefore dismissed as duplicative of closed appeal No. 22-16150. The scope of this appeal is limited to a review of the district courts post-judgment orders entered on July 10, 2023 A review of this courts docket reflects that the filing and docketing fees for this appeal remain due. Within 21 days of this order, appellant must pay to the district court the $505.00 filing and docket ing fees for this appeal and file in this court proof of payment or file in this court a motion to proceed in forma pauperis. A review of the record also suggests that the questions raised in this appeal of the district courts July 10, 2023, post-judgment orders are so insubstantial as not to require further argument. Accordingly, within 21 days of this order, appellant must move for voluntary dismissal of the appeal or show cause in writing why the appeal should not be either summarily affirmed affirmed, or dismissed as frivolous See United States v. Hooton , 693 F.2d 857, 858 (9th Cir. 1982) (stating standard for summary affirmance)); see also 28 U.S.C. 1915(e)(2). If appellant elects to show cause, appellee appellees may file a response within 10 days after service of appellants memorandum memorandum. Failure to fully comply with this order will result in dismissal of this appeal by the Clerk. See 9th Cir. R. 42 1. Briefing is suspended pending further order of the court. The Clerk will serve on appellant: (1) a form motion to voluntarily dismiss the appeal appeal; (2) a Form 4 financial affidavit; and ( 3) a form statement that the appeal should go forward.
