The order warned appellant that failure to comply may result in the dismissal of the appeal. To date, appellant has not responded to the courts order. Accordingly, this appeal is dismissed for failure to prosecute. See 9th Cir. R. 42-1. On August 8, 2023, this court issued an order directing appellant to pay $505.00 to the district court as the docketing and filing fees for this appeal, or file in this court a motion to proceed in forma pauperis. The August 8, 2023 order was returned to the court as undeliverable, and resent to appellant at USP Victorville on August 23, 2023. Appellant has filed a motion for injunctive relief and submitted the opening brief, but failed to address the fee status issue. Within 21 days from the date of this order, appellant must pay $505.00 to the district court as the docketing and filing fees for this appeal, or submit to this court a motion to proceed in forma pauperis. The filing of a motion to proceed in forma pauperis will automatically stay the briefing schedule under Ninth Circuit Rule 27-11. All pending motions will be addressed following appellants compliance with this order. If appellant fails to comply with this order, the appeal will be dismissed automatically by the Clerk under Ninth Circuit Rule 42-1.
