| Filing 5 District Court Order/Notice Received. EO: On September 14, 2023, Plaintiff Thunderfoot ("Plaintiff") filed an "Affidavit of Truth for Plaintiff Thunderfoot's Reply to Document #341." ECF No. 342 ("Affidavit of Truth"). The court construed that filing as a Motion for Reconsideration, and denied it on September 19, 2023. ECF No. 343. Plaintiff then filed a notice of appeal. ECF No. 346. On November 1, 2023, Plaintiff filed an "Official Notice of Default by Affidavit of Truth." ECF No. 350 ("Official Notice"). In this filing, Thunderfoot apparently claims that because the court failed to respond to her Affidavit of Truth, the court is now in "DEFAULT" and "everything in the Affidavit [of Truth] is true and correct by [the court's] silence of 'TACIT PROCURATION.'" ECF No. 350 at PageID.3356. The court takes no action on the Official Notice. Further, the court will not respond to Plaintiff's further requests, whether to an Affidavit of Truth or Official Notice. And because it is somewhat unclear if the Official Notice is intended as part of her pending appeal, the Clerk of Court is directed to provide a copy of ECF No. 350 to the Ninth Circuit.
