July 7, 2023 Opinion or Order Filing 13 ORDER FILED. The motion (Docket Entry No. 6) of Walter K. Pyle to withdraw as counsel of record under Anders v. California, 386 U.S. 738 (1967), is referred to the panel assigned to hear the merits of this appeal. The panel will conduct an independent review of the record. See Penson v. Ohio, 488 U.S. 75, 80 (1988). After it conducts its review, the merits panel will determine whether counsel will be allowed to withdraw and whether new counsel will be appointed. See id. at 83-84. Appellant may file a pro se supplemental opening brief raising, in his own words, any issues in his case by August 21, 2023. If appellant files a pro se supplemental opening brief, on or before September 20, 2023, appellee must file the answering brief or notify this court by letter that no answering brief will be filed. If appellee files an answering brief, it must be served on appellant individually. The optional reply brief will be due within 21 days after service of the answering brief if one is filed. Whether or not appellant submits the optional pro se briefs, the panel will conduct an independent review of the record of the case. The Clerk will enter on the docket the following address for appellant: Reg. No. 61872-298, USP Victorville, U.S. Penitentiary, P.O. Box 3900, Adelanto, CA 92301.
