Filing 6 Filed order MEDIATION (RK): An in-person mediation will be held on October 2, 2023, at 10:00 a.m. Pacific Time at the U.S. Court of Appeals, 125 South Grand Avenue, Mural Room, Pasadena, California. Unless excused by the Circuit Mediator in advance, each party shall be represented by counsel of record and a client representative having full authority to negotiate and settle the case. Brief, informal, confidential (not served on opposing counsel and not filed with the court) mediation statements should be submitted to Circuit Mediator Robert Kaiser by email (Robert_Kaiser@ca9.uscourts.gov) on or before September 27, 2023. The mediation statements are an opportunity to provide insights into each partys goals and interests, potential impediments to settlement, past settlement discussions, and factors outside the litigation that might impact the parties approaches to settlement. The Circuit Mediator has full access to the appellate and district court dockets, so it is not necessary to repeat legal arguments nor attach copies of pleadings and orders. The mediation statements shall also provide the names and representative capacities of those who will attend the mediation. The confidentiality rules set out in the attached document cover all mediation communication, both oral and written. Counsel must review and provide a copy of the Confidentiality Rules to all mediation participants. Participants should plan to spend the entire day engaged in meaningful settlement discussions.
