July 24, 2023	Filing 2 Order filed (Appellate Commissioner): Thyrone Ryan Stewart has filed a 28 U.S.C. 2254 habeas corpus petition, which challenges Stewarts 2000 Riverside County Superior Court convictions for assault by means of force likely to cause great bodily injury, misdemeanor battery, and two counts of infliction of corporal punishment on a spouse, in which he was sentenced in 2001 to 51 years to life imprisonment in case number RIF091928. Stewarts petition references his habeas petition pending in Central District of California case number 5:23-cv-00544-MWF-KS. The petition also includes a Motion for C.O.A. And objection to Recommendation, which appears to be Stewarts objections to the Report and Recommendation filed by the magistrate judge in this district court case on June 7, 2023. An application for a writ of habeas corpus must be made to the district court. See 28 U.S.C. 2241(d). If a 2254 petition is filed in the court of appeals, the application must be transferred to the appropriate district court. Fed. R. App. P. 22(a); see 28 U.S.C. 1631, 2241(b). Accordingly, the Clerk will transfer the petition filed at Docket Entry No. [ # 1 ], which includes Stewarts objections to the report and recommendation, to the United States District Court for the Central District of California case number 5:23-cv-00544-MWF-KS, for whatever consideration that court deems appropriate. The attached proof of service demonstrates that Stewart mailed the request for a COA and objection to recommendation to the court on June 19, 2023. The Clerk will also serve this order on the chambers of the Honorable Michael W. Fitzgerald and the Honorable Karen L. Stevenson.
