October 2, 2023 Opinion or Order Filing 15 ORDER FILED. Lisa B. Fitzgerald, Appellate Commissioner. The motion (Docket Entry No. 13) of Thomas P. Sleisenger to withdraw as counsel of record under Anders v. California, 386 U.S. 738 (1967), is referred to the panel assigned to hear the merits of this appeal. The panel will conduct an independent review of the record. See Penson v. Ohio, 488 U.S. 75, 80 (1988). After it conducts its review, the merits panel will determine whether counsel will be allowed to withdraw and whether new counsel will be appointed. See id. at 83-84. Appellants unopposed motion (Docket Entry No. 10-1) to file under seal the motion to seal, counsels declaration in support of the motion, and the Anders brief is granted. The Clerk will file under seal the motion to seal and counsels declaration (Docket Entry No. 10) and the Anders brief (Docket Entry No. 14). Appellant may file a pro se supplemental opening brief raising, in her own words, any issues in his case by November 13, 2023. If appellant files a pro se supplemental opening brief, on or before December 13, 2023, appellee must file the answering brief or notify this court by letter that no answering brief will be filed. If the government files an answering brief, it must be served on appellant individually. The optional reply brief is due within 21 days after service of the answering brief if one is filed. Whether or not appellant submits the optional pro se briefs, the panel will conduct an independent review of the record of the case. The Clerk will serve this order on appellant individually.
