May 17, 2024 Opinion or Order Filing 3 ORDER FILED. Appellant was incorrectly notified that fees were due in this appeal. Appellant is informed that his in forma pauperis status continues on appeal. See Fed. R. App. P. 24(a)(3). Accordingly, the docket has been amended to reflect this status, and appellant is not required to pay fees. It appears that appellant is appealing from the judgment entered by the district court on March 29, 2021. If so, his appeal is untimely. See Fed. R. App. P. 4(b)(1)(A), (b)(4). Within 21 days of this order, appellant must file a motion for voluntary dismissal of this appeal or show cause in writing why it should not be dismissed for lack of a timely notice of appeal. Alternatively, if appellant intends to appeal from a different district court order, he must so notify the court. If appellant elects to show cause, appellee may file a response within 10 days after service of appellants memorandum. If appellant does not comply with this order, the court may dismiss this appeal for failure to prosecute. See 9th Cir. R. 42-1. Briefing is suspended pending further order of the court.
