ORDER FILED. Agreements to dismiss claims without prejudice . . . suggest manipulation of appellate jurisdiction. See Am. States Ins. Co. v. Dastar Corp., 318 F.3d 881, 885-92 (9th Cir. 2003) (noting that a stipulation to dismiss certain claims without prejudice may be manipulative where it permit[s] the re-institution of [those] claims if the district court[] [is] reversed on appeal); see also Dannenberg v. Software Toolworks Inc., 16 F.3d 1073, 1077 (9th Cir. 1994) ([L]itigants should not be able to avoid the final judgment rule without fully relinquishing the ability to further litigate unresolved claims.). This court may therefore lack jurisdiction over this appeal. Within 21 days, appellant must either file a statement explaining why the appeal should not be dismissed for lack of jurisdiction or move for voluntary dismissal of the appeal. If appellant does not comply with this order, the court will dismiss this appeal. See Ninth Circuit Rule 42-1. If appellant files a statement, a response may be filed within 10 days. Briefing is stayed. [Entered: 06/27/2024 03:12 PM]
