The federal appellants motion to stay the district courts October 11, 2024 judgment (Docket Entry No. 8 in No. 24-6576) is granted. See Nken v. Holder, 556 U.S. 418, 434 (2009) (defining standard for stay pending appeal). In light of the separate stay motion filed in appeal Nos. 24-6338 and 24-6603, we have not considered the Regents of the University of Californias partial joinder to the federal defendants stay motion. The motions for leave to file an amicus curaie brief and to strike the partial joinder (Docket Entry Nos. 37, 39 in 24-6576, 21 in 24-6338, 20 in 24-6603) are denied as moot. The motion to stay filed in appeal Nos. 24-6338 and 24-6603 is referred to the panel that will be assigned to decide the merits of these appeals. The motion to consolidate appeal Nos. 24-6338 and 24-6603 and expedite (Docket Entry No. 11 in 24-6338, 9 in 24-6603) is granted in part. Appeal Nos. 24-6338 and 24-6603 are consolidated. We expedite these appeals. The opening briefs are due January 17, 2025. The answering briefs are due February 18, 2025. The optional reply briefs are due within 21 days after service of the answering brief. No streamlined extensions of time will be approved. See 9th Cir. R. 31-2.2(a)(1).
