ORDER FILED. On June 3, 2024, the district court granted plaintiff Nguyen and defendant Coinbase, Inc.s stipulation to compel arbitration and stay proceedings as to defendant Coinbase, Inc. On November 20, 2024, the district court granted defendant One Finance, Inc.s motion to dismiss. A district courts dismissal order is not appealable under 28 U.S.C. 1291, however, unless it disposes of all claims as to all parties or unless judgment is entered in compliance with Federal Rule of Civil Procedure 54(b). Romoland Sch. Dist. v. Inland Empire Energy Ctr., LLC, 548 F.3d 738, 747 (9th Cir. 2008) (citing Chacon v. Babcock, 640 F.2d 221, 222 (9th Cir. 1981)); see also 28 U.S.C. 1291; Fed. R. Civ. P. 54(b). Because the claims against defendant Coinbase, Inc. remain pending in the district court, this court may therefore lack jurisdiction over these cross-appeals. Within 14 days, appellant Nguyen must either file a motion to voluntarily dismiss appeal No. 25-1290 or file a statement explaining why it should not be dismissed. Within 10 days after appellant files a motion or statement, cross-appellant One Finance, Inc. must either file a motion to voluntarily dismiss appeal No. 25-1292 or file a statement explaining why it should not be dismissed. If appellant files a statement, cross-appellant may also file a response at that time. If either party fails to comply with this order, the court will dismiss their respective appeal. See 9th Cir.
