ORDER FILED. The notice of appeal was not filed within 30 days after the district courts October 11, 2024 order. See 28 U.S.C. 2107(a); Fed. R. App. P. 4(a)(1)(A). Appellants filed a motion for reconsideration on November 11, 2024, but that motion does not appear to be a timely tolling motion under Federal Rule of Appellate Procedure 4(a)(4). Accordingly, to the extent that appellants challenge the October 11, 2024, the court may lack jurisdiction over this appeal. See United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional). The notice of appeal was filed within 30 days after the district courts March 10, 2025 order denying the motion for reconsideration. But the court may lack jurisdiction over a challenge to the March 10, 2025 under the collateral order doctrine. And, even if the court has jurisdiction over such a challenge, the appeal may be appropriate for summary disposition. See United States v. Hooton, 693 F.2d 857, 858 (9th Cir. 1982). Within 21 days, appellants must either file a motion to voluntarily dismiss this appeal or file a statement explaining why it should not be dismissed. If appellants elect to file a statement, they must include an explanation for whyif the scope of this appeal is limited to review of the district courts March 10, 2025 orderthe issues to be raised in this appeal are substantial enough to justify full briefing. If appellants do not do so, the court will dismiss the appeal. See 9th Cir. R. 42-1. If appellants file a statement, appellee may file a response within 10 days. Briefing is stayed.
