ORDER FILED. Lisa B. Fitzgerald, Appellate Commissioner. Appeal No. 24-3587 was opened after appellants filed a notice of appeal on June 6, 2024, from the district courts order entered June 4, 2024. This court stayed No. 24-3587 on September 13, 2024, pending the district courts ruling on a motion for reconsideration filed June 6, 2024. On February 20, 2025, the district court denied the motion to reconsider its June 4, 2024 order, and entered a final order dismissing the action. Appeal No. 25- 1870 was opened after appellants filed a notice of appeal on March 20, 2025, from the district courts order and judgment entered February 20, 2025. The stay of proceedings in appeal No. 24-3587 is lifted. Appeal Nos. 24- 3587 and 25-1870 are consolidated. The consolidated appeals will proceed based on the fee paid for appeal No. 24-3587. The motions for initial hearing en banc and summary disposition are referred to the panel assigned to hear the merits of these appeals. See 9th Cir. Gen. Ord. 5.2 The consolidated opening brief was filed on May 1, 2025. The answering brief is due June 16, 2025. The optional pro se reply brief is due 21 days after the answering brief is served.
