ORDER FILED. Lisa B. Fitzgerald, Appellate Commissioner. Counsel Michael Donahoe of the Federal Defenders of Montanas motion (Docket Entry No. 8) to withdraw under Anders v. California, 386 U.S. 738 (1967), is referred to the panel assigned to hear the merits of this appeal. The panel will conduct an independent review of the record and decide whether to allow counsel to withdraw and whether to appoint new counsel. See Penson v. Ohio, 488 U.S. 75, 80, 83-84 (1988). Appellant has the option to file a pro se supplemental opening brief to raise in appellants own words any issues in this case. The brief is due September 23, 2025 and if one is filed, appellee must file either an answering brief or a notice that no answering brief will be filed by October 23, 2025. If appellee files an answering brief, appellee must serve it on appellant individually and the optional reply brief will be due 21 days after the answering brief is served. Whether or not appellant files a pro se supplemental brief, the panel will independently review the record. The clerk will serve this order on appellant individually.
